Accommodation Terms and Conditions

Article 1 (Scope of Application)

1.
Any accommodation contract and related agreements concluded between the Inn and guests shall be governed by these Terms and Conditions. Matters not stipulated herein shall be governed by laws and regulations or generally accepted practices.
2.
Notwithstanding the preceding paragraph, if the Inn agrees to special provisions within the scope not contrary to laws and regulations or customs, such special provisions shall prevail.
3.
For accommodation reservations made through online travel agency websites other than the Inn's official website (hereinafter referred to as “OTAs”), where such websites provide notices or displays indicating that the reservation is subject to the Inn's Accommodation Terms and Conditions, the conclusion of the reservation shall be deemed to constitute the guest's agreement to these Terms and Conditions.

Article 2 (Application for Accommodation Contract)

1.
A person who intends to apply for an accommodation contract shall provide the Inn with the following information:
(1)
Name of the guest
(2)
Date of stay and expected time of arrival
(3)
Accommodation charges (in principle, based on the basic accommodation charges listed in Appendix 1)
(4)
Other matters deemed necessary by the Inn
2.
If a guest requests an extension of stay beyond the dates specified in Item (2) of the preceding paragraph during their stay, the Inn shall treat such request as a new application for an accommodation contract at the time the request is made.

Article 3 (Conclusion of Accommodation Contract)

1.
An accommodation contract shall be deemed concluded when the Inn accepts the application described in the preceding Article. However, this shall not apply if the Inn proves that it did not accept the application.
2.
Upon conclusion of the accommodation contract pursuant to the preceding paragraph, the guest shall pay a deposit determined by the Inn by the designated date, up to the amount of the basic accommodation charge for the accommodation period (limited to three days if the stay exceeds three days).
3.
The deposit shall first be applied to the final accommodation charges payable by the guest. If circumstances arise to which Article 6 or Article 16 apply, the deposit shall be applied in the order of penalty charges and then compensation, and any remaining balance shall be refunded at the time of payment under Article 10.
4.
If the guest fails to pay the deposit by the designated date, the accommodation contract shall lose its validity, provided that the Inn has notified the guest of the payment deadline.

Article 4 (Special Provisions Not Requiring Deposit)

1.
Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Inn may accept special provisions under which no deposit is required after the contract is concluded.
2.
If the Inn does not request payment of a deposit or specify a payment deadline at the time of accepting the accommodation contract, such case shall be treated as acceptance of the special provisions described in the preceding paragraph.

Article 5 (Refusal to Conclude Accommodation Contract)

1.
The Inn may refuse to conclude an accommodation contract in the following cases:
(1)
When the application does not comply with these Terms and Conditions;
(2)
When there are no rooms available due to full occupancy;
(3)
When the person seeking accommodation is deemed likely to act in violation of laws, public order, or good morals;
(4)
When the person seeking accommodation falls under any of the following:
a.
Organized crime groups, members thereof, associate members, related persons, or other antisocial forces as defined by law;
b.
Corporations or organizations whose business activities are controlled by organized crime groups or members thereof;
c.
Corporations whose officers include members of organized crime groups;
(5)
When the person seeking accommodation engages in conduct that causes significant inconvenience to other guests;
(6)
When the person seeking accommodation is clearly recognized as having an infectious disease;
(7)
When violent demands or unreasonable burdens related to accommodation are made;
(8)
When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable reasons;
(9)
When the case falls under Article 5 of the Gifu Prefecture Ryokan Business Enforcement Ordinance.

Article 6 (Guest's Right to Cancel)

1.
Guests may cancel the accommodation contract by notifying the Inn.
2.
If a guest cancels all or part of the accommodation contract for reasons attributable to the guest, the Inn shall charge a cancellation fee as listed in Appendix 2.
3.
If a guest fails to arrive by 8:00 p.m. on the day of stay (or two hours after the expected arrival time if specified), the Inn may treat the contract as canceled by the guest.

Article 7 (Inn's Right to Cancel)

1.
The Inn may cancel the accommodation contract in the following cases:
(1)
When the guest is deemed likely to act, or has acted, in violation of laws, public order, or good morals;
(2)
When the guest falls under any of the categories listed in Article 5, Paragraph 1, Item (4);
(3)
When the guest engages in conduct that significantly inconveniences other guests or staff, including threatening behavior, abusive language, discriminatory or sexual remarks, prolonged occupation, or other socially unacceptable conduct;
(4)
When the guest is clearly recognized as having an infectious disease;
(5)
When the guest makes violent demands, excessive apology demands, demands for monetary compensation, demands for prostration, or other unreasonable requests, or interferes with the Inn's operations;
(6)
When accommodation cannot be provided due to force majeure such as natural disasters;
(7)
When the case falls under Article 5 of the Gifu Prefecture Ryokan Business Enforcement Ordinance;
(8)
When the guest violates fire prevention rules such as smoking in bed, tampering with fire-fighting equipment, or other prohibited acts specified in the Inn's usage rules.

Article 7-2 (Handling of Charges upon Cancellation)

1.
When the Inn cancels the accommodation contract pursuant to the preceding Article, no charges shall be collected for accommodation services not yet provided.
2.
When cancellation is due to the guest's fault under Article 7, Paragraph 1, Items (1), (2), (3), (5), or (8), the Inn shall not refund accommodation charges that would otherwise have been received.

Article 8 (Registration)

1.
Guests shall register the following information at the front desk on the day of arrival:
(1)
Name, age, gender, address, and occupation;
(2)
For foreign nationals: nationality, passport number, place and date of entry into Japan;
(3)
Date and expected time of departure;
(4)
Other matters deemed necessary by the Inn.
2.
Guests intending to pay by credit card or other substitutes for cash shall present such means at the time of registration.

Article 9 (Compliance with House Rules)

1.
Guests shall comply with the Inn's house rules while on the premises.

Article 10 (Payment of Charges)

1.
The breakdown of accommodation charges shall be as listed in Appendix 1.
2.
Payment shall be made at the front desk at the time of departure or when requested by the Inn, using cash or other methods accepted by the Inn.
3.
Accommodation charges shall be payable even if the guest voluntarily chooses not to stay after the room has been made available.

Article 11 (Liability of the Inn)

1.
The Inn shall compensate guests for damages caused due to reasons attributable to the Inn in the performance or non-performance of the accommodation contract.
2.
The Inn carries Ryokan Liability Insurance to cover emergencies such as fire.

Article12 (Inability to Provide Contracted Room)

1.
If the Inn cannot provide the contracted room, it shall, with the guest's consent, arrange alternative accommodation under equivalent conditions as far as possible.
2.
If no alternative accommodation can be arranged, the Inn shall pay compensation equivalent to the cancellation charge, which shall be applied toward damages, unless the Inn is not responsible.

Article 13 (Handling of Deposited Items)

1.
The Inn shall compensate for loss or damage to items, cash, or valuables deposited at the front desk, except in cases of force majeure. Compensation for undeclared cash or valuables shall be limited to JPY 100,000.
2.
For items brought into the Inn and not deposited, the Inn shall compensate only if damage is caused by the Inn's intent or negligence, subject to the same limit.

Article 14 (Storage of Baggage)

1.
Baggage arriving prior to the guest's stay shall be stored only with the Inn's prior consent.
2.
Lost items left after check-out shall be stored for ten (10) days including the date of discovery, after which they will be disposed of.

Article 15 (Parking Liability)

1.
Use of the parking facilities is at the guest's own risk, and the Inn assumes no responsibility for vehicle management.

Article 16 (Guest Liability)

1.
Guests shall compensate the Inn for any damages caused by the guest's intent or negligence.

Article 16-2 (Smoking Prohibition and Violations)

1.
Guests shall comply with laws, these Terms and Conditions, and the Inn's house rules, and cooperate with the smooth operation of the Inn.
2.
The entire premises (including guest rooms and common areas) are non-smoking. Smoking, including electronic and heated tobacco products, is prohibited except in designated smoking areas.
3.
If a violation is confirmed, the Inn may cancel the accommodation contract and request the guest to vacate the premises. In such cases, no refund of accommodation charges shall be made if the cancellation is attributable to the guest.
4.
The Inn may charge the guest the actual costs of cleaning, deodorization, repairs, and other damages resulting from the violation.

(1)The percentage above shows the percentage of the Penalty against the Basic Accommodation Charge.

(2)In the case that the number of days for accommodation has been reduced, Penalty for One Day (the first day of accommodation) shall be charged,regardless of the number of days reduced.
